Terms of Service

Baghza connects neighbors who want to share, swap, or offer homegrown and garden produce. We are a technology platform — not a grocery store, food distributor, or food safety inspector.

We do not grow, harvest, inspect, prepare, package, test, or guarantee any food listed on Baghza. All listings are created by individual users, and all exchanges happen directly between those users. Baghza is not a party to any transaction.

Homegrown and garden food is not commercially inspected. By using Baghza, you acknowledge and accept that:

• ✓Baghza cannot verify whether produce has been treated with pesticides, herbicides, or other chemicals.
• ✓Baghza cannot verify whether food is free of allergens, bacteria, mold, parasites, or other contaminants.
• ✓Baghza cannot verify how food has been stored, harvested, or handled.
• ✓You are solely responsible for washing, inspecting, preparing, and safely consuming any food you obtain through Baghza.
• ✓If you have food allergies or dietary restrictions, you must ask the provider directly before accepting any item.

Consume all produce at your own risk.

If you believe food made you sick, seek medical attention immediately and report the issue to your local county health department and to us at hello@baghza.com.

Baghza does not process, handle, hold, or facilitate any payments. All financial exchanges — including cash, Venmo, PayPal, or any other method — occur directly between users, entirely outside of Baghza.

When a listing is marked as an “offer,” Baghza merely facilitates the introduction. We have no visibility into, and no responsibility for, the payment arrangement.

To use Baghza, you must:

• ✓Be at least 18 years old.
• ✓Be a resident of the United States.
• ✓Provide accurate, real identity information when creating your account.
• ✓Not create multiple or fake accounts.

By creating an account, you represent that you meet these requirements. We reserve the right to terminate accounts that do not comply.

Baghza accounts are active after signup. Browsing public listings is open to all visitors, and signed-in users can post listings, claim produce, and message neighbors.

We may limit, block, or terminate accounts at any time for safety, abuse prevention, fraud prevention, or policy violations.

You agree not to:

• ✕Post false, misleading, or inaccurate listings (including misrepresenting the quality, quantity, or safety of food).
• ✕Resell produce obtained through Baghza commercially without disclosing that intent.
• ✕Harass, threaten, or abuse other users.
• ✕Send spam, unsolicited messages, or promotional content to other users.
• ✕Create fake accounts or impersonate another person or entity.
• ✕Use Baghza to collect personal information about other users beyond what is needed to complete a trade.
• ✕Scrape, copy, or systematically extract data from Baghza.
• ✕Attempt to circumvent platform security, authentication, or access controls.
• ✕Use Baghza for any unlawful purpose.

Violations may result in immediate account suspension or termination.

Read this carefully — it limits what Baghza owes you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAGHZA AND GSB TEAM SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Any food consumed through produce obtained on Baghza.
• Any interaction, exchange, meeting, or dispute between users.
• Any inaccuracy in a user’s listing or profile.
• Any interruption or unavailability of the platform.

Because Baghza is a free platform, our maximum direct liability to you for any claim arising from your use of Baghza is $0.00 (zero dollars).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Baghza, GSB Team, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to:

• Any listing you post, including the food itself or any information you provide about it.
• Any exchange, interaction, or dispute with another user.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.

Baghza may feature partner nurseries, real estate professionals, educators, and other local businesses. These are paid or promotional relationships.

Each such partner is labeled “Paid Partner” on the platform. This labeling constitutes the disclosure required by the Federal Trade Commission (FTC) for commercial endorsements and material connections.

Baghza does not independently verify partner claims, certifications, or service quality. A “Paid Partner” label does not constitute Baghza’s endorsement of any product or service.

Please try to resolve any dispute with us informally first by emailing hello@baghza.com. Most issues can be resolved quickly.

If informal resolution fails, any dispute arising from these Terms or your use of Baghza will be resolved through binding individual arbitration, not in court and not as part of a class action or class arbitration.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any arbitration shall be conducted in Salt Lake County, Utah.

You waive any right to participate in any class action lawsuit or class-wide arbitration relating to Baghza.

Baghza may suspend or permanently terminate your account at any time, for any reason, with or without notice — including for violation of these Terms, conduct that harms the community, or if we decide to shut down or modify the platform.

You may close your account at any time by emailing hello@baghza.com. See our Privacy Policy for data retention details.

We may update these Terms at any time. When we do, we’ll update the “Last updated” date at the top of this page. If changes are material, we may also notify you by email or in-app notice.

Your continued use of Baghza after any update constitutes your acceptance of the revised Terms. If you don’t agree, please stop using the platform and close your account.
